This course will examine the legislative history and jurisprudence of the Fourteenth Amendment, focusing primarily on the Equal Protection Clause. The course studies the application of the Amendment to women, to people of color, to economic status, and to sexual orientation. It emphasizes the historical context in which the Supreme Court made its decisions applying the Amendment, journeying from the Reconstruction Era to Jim Crow and the Lochner Era. We will study the road to Brown v. Board of Education, the desegregation era cases, and the rise of “reverse discrimination” claims.
